  • Marbury v Madison

    It established judicial review, and it was against the public opinion. It was a democratic case that was passed, due the fact it was against public opinion it was controversial. Lastly it's still common today.
  • Plessy v Ferguson

    This case was about segregation by race on railroads, it went with the public opinion. It was less democratic and very controversial due to the fact it allowed segregation. This is no longer a principle/trend.
  • Brown v board of education

    It's about racial segregation in schools, this was more democratic and went with the public opinion. Very controversial due to the fact that the norm was segregation everywhere and this went against that norm. This is still a principle today.
  • Roe v Wade

    This case made abortion legal across the country. It was so split it is impossible to tell if it went with or against public opinion. It was less democratic and controversial because of the even split of votes. This case is still a principle today.
  • Obergefell v hodge

    This case made same sex marriage legal and went with public opinion. More democratic and very controversial due to it going against most religious beliefs. Still a principle today.
