  • Hobson Vs. Hansen 1967-1969

    This was the first case to question the placement of certain students in special education but didn't stop it right then and there. Julius Hobson, a civil rights activist, filed a class action suit against Superintendent Carl Hansen for allegedly deny black and poor students equal education. The Federal court ruled that there was discrimination.

  • PARC Vs. Commonwealth of Pennsylvania

    Pennsylvania Assc. for Retarded Children (PARC) sued the Commonwealth of Pennsylvania for the rights of children age 5 and up to attend public schools. Retarded students were said to be unteachable and bothersome. In 1972 both sides came to a settlement, District Court Judge, Masterson requested the State to provide free public education to all students ages 6-21 with disabilities.

    A 3rd grade student's parents stated that they should be reimbursed for tuition for having to pull their child from public education to private school because the school offered very minimal IEP help which resulted in the student having difficulties learning. Because of this under IDEA parents can now be reimbursed if it is proven that a school has disagreed with a child's IEP.
