    Brown V Board of Education
    This historical landmark case deemed that segregation on the basis of race was a violation to equal education opportunity. This court case was important because it influenced legislation to set the path for education of individuals with disabilities to have the same right to education. This case paved the way for future legislation of rights for individuals with disabilities.
  • ESEA Elementary and Secondary Education Act

    ESEA Elementary and Secondary Education Act
    ESEA was the first federal grant program enacted to protect and provide for individuals with disabilities and to encourage states to create and improve programs for students with disabilities. This was later revised in 1970 and called the Education of the Handicapped Act.
  • Mills vs Board of Education of the District of Colombia

    Mills vs Board of Education of the District of Colombia
    This case recognized that handicapped children were being excluded from public school. It required the state to provide adequate alternative education services aligned with child's status and progress. It required schools to describe curricula, objectives, teacher qualifications, and supplemental services. Influenced the drafting of P.L. 94-142.

    Section 504 Vocational Rehabilitation Act
    Section 504 prohibited discrimination against students with disabilities in federally funded programs or state or local organizations. Prohibits discrimination in public education, employment, or health and social services. This law created greater access to opportunities in work, communities, and college and universities. Equal opportunity and service for all individuals with disabilities.

    Education for All Handicapped Children Act (EAHCA)
    Known as the mainstreaming Law, requires states to provide free and appropriate education for children with disabilities (ages 5 to 18). Required IEP's, and defined least restrictive environment. This act linfluenced later legislation IDEA in 1990, and IDEIA in 2004.

    IDEA Individuals with Disabilities Act P.L. 101-476
    Established "People-First" language. Included social work, assistive technology, and rehab services to special education services. Provides due process and confidentiality for students and parents. Includes autism and traumatic brain injury to disability category. Requires states to educate and provide for transition services into employment.

    Individuals with Disabilities Education Act (IDEA) P.L. 105-17
    This law required that students with disabilities could still recieve education even after explusion. Schools must ensure that students have access to gen ed curriculum. Special ed staff can assist gen ed students. Requires a gen ed teacher to be on the IEP team. Students can take statewide and district assessments. requires behavior management if needed.

    IDEIA Individuals with Disabilities Education Improvement Act P.L.108-446
    Allows districts to use RTI model for determining specific learning disabilities and no longer requires severe achievement and intellectual discrepancy to determine qualification for RTI. Increased Federal funds to provide early intervention services for students who do not need spec ed. Elminates short term objectives in IEP's. Raises standards for SPED licensure. Adopts policies to prevent disproportionate representation of students in SPED by race and ethnicity.
