Evaluation timeline for Students w/Disabilities

  • Request for Initial Evaluation

    Request for Initial Evaluation
    Either a parent of a child or public agency may initiate a request for an initial evaluation to ascertain if a child is a child with a disability in accordance with 300.301(b).
  • Request for Extension

    Request for Extension
    Upon consent of the parties, the 60 day time limit required by ED 1107.01(d) may be extended by a specific number of days not to exceed 30 days total.
  • Procedures for Initial Evaluation

    Procedures for Initial Evaluation
    Per 300.301(b)&(c), this must be conducted within 60 days of receiving parental consent for the evaluation, or iif state establishes a timeline within which the evaluation must be conducted, then that timeline must be uses. Evaluation must consist of procedures to determine if the child is with a disability under 300.8 and to ascertain his/her educational needs.
  • Disposition of Referral

    Disposition of Referral
    Upon receipt of the order for referral, the IEP team must conduct within 15 business days a meeting to determine whether concerns made by the referral can be addressed using existing pupil, support services available to all children, if any additional information is required and what testing may be needed to address the remaining concerns. 300.311(g)
  • IEP Eligibility & Timeframe

    IEP Eligibility & Timeframe
    Once the child has been determined to be eligible for special education services and under a specific category or code, the team must present written notice of its decision. Per 300.323(C)(1) A meeting must take place within 30 days to develop an IEP of a determination that a child needs special education services. Also, an IEP must be in place at the beginning of the school year.
