    The Act's purpose was to promote economic fairness and competitiveness and to regulate interstate commerce.
  • Sherman Act case #1

    United States v. Union Pacific R. Co.
    The purchase by the Union Pacific Railroad Company of forty-six percent of the stock of the Southern Pacific Company, with the resulting control of the latter's railway system by the former, is an illegal combination in restraint of interstate trade within the purview of the Sherman Anti-Trust Act of 1890 and must be dissolved. The case was ruled by the Supreme Court.

  • The Clayton Act

    Intended to strengthen earlier antitrust legislation, the act prohibits anti competitive mergers, predatory and discriminatory pricing, and other forms of unethical corporate behavior.
  • The Robinson-Patman Act

    Federal law intended to prevent price discrimination. The law prevents distributors from charging different prices to various retailers.
  • The Celler-Kefauver Act

    Was designed to prevent certain mergers and acquisitions from creating monopolies or otherwise significantly reducing competition in the United States.
  • Clayton Act case #1

    FTC v. Consolidated Foods
    The Federal Trade Commission held that the acquisition violated 7 of the Clayton Act, as the opportunity for reciprocal buying in this oligopolistic industry created a probability of a substantial lessening of competition and ordered divestiture. The case was ruled by the Supreme Court.

  • Robinson-Patman Act Case #1

    FTC v. Borden Co.
    FTC found the milk to be of like grade and quality as required for the applicability of § 2(a) of the Robinson-Patman Act, holding the price differential to be discriminatory. The case was ruled by the Supreme Court.
  • Celler-Kefauver Act Case #1

    United States v. Falstaff Brewing Corporation
    Falstaff, the Nation's fourth largest beer producer, agreed to acquire the largest seller of beer in the New England market rather than enter de novo. The case was ruled by the Supreme Court.

  • Clayton Act Case #2

    FTC v. USA Beverages, Dilraj Mathauda, Jeff Pearson, David Mead, Silvio Carrano
    The FTC filed a complaint against USA Beverages and the men mentioned above, for alleging violations of section 5 of the FTC act and the FTC’s Trade Regulation Rule. The case was ruled by the Supreme Court.

  • Sherman Act Case #2

    Ohio v. American Express:
    Ohio and several other states sued Amex arguing the Sherman Antitrust Act bans the contract between Amex and the merchants because the contract is anti-competitive.To prove a violation of the Sherman Act, the states must prove the contract produces anticompetitive effects in the market. The case was ruled by the Supreme Court.
